Regional addenda to the Terms of Use
Version 1.0. Last updated: October 30, 2026
These addenda supplement Infusion's Terms of Use for people who reside in the United States, the European Union or the United Kingdom. Where they differ, they prevail over the Terms of Use for residents of those regions. Otherwise, the Terms of Use apply.
A. United States
1. Automatic renewal. Paid plans renew automatically for the same period, at the price shown at purchase, until you cancel. You can cancel at any time from your account dashboard, without having to talk to anyone, and the cancellation applies to the next renewal. If your plan renews annually, we will email you before the renewal with the amount and the billing date.
2. Informal resolution. Before starting an arbitration or lawsuit, the party with a claim must send it in writing to the other party, describing the problem and what it is asking for. Claims against Infusion go to [email protected]. The parties have 60 days to try to resolve the claim before moving forward.
3. Individual arbitration. If the claim is not resolved, it will be decided by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and governed by the Federal Arbitration Act. The arbitration may take place by video or in the county where you reside. Fees follow the AAA rules for consumers.
4. Exceptions. Either party may bring a claim in small claims court if it qualifies, and may seek urgent relief in court to protect intellectual property rights.
5. Class action and jury waiver. You and Infusion may bring claims only individually, and not as a plaintiff or class member in any class or representative action. You and Infusion waive the right to a jury trial. If this class action waiver is found unenforceable for any claim, that claim will be decided in court and not in arbitration.
6. Right to opt out of arbitration. You may opt out of arbitration by emailing [email protected] within 30 days after you first accept the Terms, with your name, your account email and the words "I opt out of arbitration". Opting out does not affect the rest of the Terms.
7. Governing law. Arbitration is governed by the Federal Arbitration Act. Other matters are governed by the Terms of Use, without prejudice to the consumer protection laws of the state where you reside.
8. Privacy. If your state's privacy law gives you rights over your personal data, you may exercise them at [email protected], as described in the Privacy Policy.
9. Copyright. Copyright infringement notices follow the procedure in item 5 of the Terms of Use. These notices can be sent to [email protected]. Accounts of users who repeatedly infringe copyright are closed.
B. European Union
1. Right of withdrawal. You may withdraw from a paid plan or service within 14 days of purchase, without giving a reason, and get back the amount paid. Just send your decision to [email protected]. You may use the model withdrawal form provided by EU law, but you do not have to.
2. Legal guarantee. You have the rights EU law grants when digital content or a digital service does not conform to the contract, including having it fixed, a price reduction or termination of the contract. Nothing in the Terms of Use limits these rights.
3. Liability. The limitations of liability in the Terms of Use do not apply where the law of your country of residence does not allow them, including cases of intent and gross negligence.
4. Venue. You may bring a claim in the courts of the country where you reside, and the mandatory consumer protection rules of that country continue to apply, even with the choice of Brazilian law in the Terms of Use.
5. Point of contact. Infusion's point of contact for users and authorities under the Digital Services Act (DSA) is [email protected], in Portuguese or English. Where the law requires it, we will designate a legal representative in the European Union and publish their details on this page.
6. Reports, measures and review. Reports, measures taken on content, statements of reasons and review requests follow item 5 of the Terms of Use. You may also turn to an out-of-court dispute settlement body certified under the DSA.
7. Switching providers. Where the Data Act applies, you may request to switch to another provider or to export the exportable data, and we will provide the assistance that regulation requires.
C. United Kingdom
For people who reside in the United Kingdom, Part B applies, with the equivalent rights under UK law, including the Consumer Rights Act 2015. The point of contact for users and authorities is [email protected].
